Michigan Democrat Hays v SOS Land and MDP Preliminary Hearing Tomorrow

From the Grand Rapids Press story, Edwards backer heads to court over primary date

[Grand Rapids Democratic activist Martha Hays] will be sitting in a federal courtroom in Grand Rapids [on Monday morning], where her lawyer will argue that the Michigan Democratic Party took away her rights and the rights of other Democrats to participate in the nominating process....

Her lawyer will ask U.S. District Judge Robert Jonker to stop the statewide primary election; if not for both parties, then at least for the Democratic party.

Actually, from what I understand Hays and her lawyer will ask that the Democratic "primary" either be delayed until a court decision or that the results of the Democratic "primary" be held by the SOS and not released to the Michigan Democratic Party.

"I can't vote and I'm sort of mad about that," said Hayes, who said she belongs to a group of local Edwards supporters who began working on his behalf more than a year ago.

"The actions of our state party have made it so that I can't vote for my candidate," Hayes said.

What annoys Hayes is the game of political brinkmanship that Michigan Democrats have played with the national Democratic party.

In a bid to make the state more relevant to the nominating process, Michigan Democrats decided to hold their presidential primary Jan. 15, one week after New Hampshire and before most of the other state primaries.

The national party, which decided Michigan should hold a primary election or caucus on Feb. 9, has said it would strip Michigan of any delegates nominated outside of its rules.....

Hayes, who spent five days last month volunteering for the Edwards campaign in Iowa, says the state party's effort to become more relevant has backfired badly.

"We have had no candidates, no community meetings. We have no press coverage, no advertising -- we have no campaigning here whatsoever," she sighed.

"... Our Michigan issues are not being discussed."

I'll try to keep everyone updated as the lawsuit story develops.  I believe the hearing is around 10:30 am on Monday.

Best of luck to Martha and her lawyer tomorrow.

Whether they succeed or fail, I urge y'all to vote Uncommitted to prevent the Forces of Coronation from winning (and effectively ending Hillary's campaign) and email the MDP to complain about their incompetence on this matter.

If the 15 January "primary" (4.00 / 1)
is cancelled by the Federal Court, the MDP will hopefully, finally, go to a DNC-approved caucus or primary on a date after 5 February.

Somehow, we have to select real delegates.

..."holding the results", which would pretty much amount to the same thing as just going through with it--unless what they mean is that "holding the results" would result in the MDP holding a caucus later on.

Then again, if they hold both a primary and a caucus, a lot of Dem primary voters won't bother showing up for the caucus since they'll figure that they already voted once...

As I understand it (and I'm not a lawyer, just married to one), if the judge concludes that the plaintiff has a "substantial likelihood of winning on the merits," there can be a judicial injunction to prevent the plaintiff from being harmed by the defendent.

If the judge decides to hold the results of the primary from the MDP, the MDP could wait until a final ruling, followed by appeals, or it could simply go back to the Delegate Selection Plan that is already OKed by the DNC: A 9 February caucus.

After an almost two hour long hearing, Judge Jonker denied the motion brought by the Michigan Democratic Party and the Secretary of State to dismiss Martha Hayes case.

The Judge also denied Mrs. Hayes request for a preliminary injunction.

Both orders are without prejudice, which gives each party the ability to renew their respective motions.

Martha Hayes et al failed to prevent the January 15 primary from taking place.  The final hurdle to the January 15 primary has been overcome.  Our delegates will be decided next Tuesday and possibly at district meetings later in the spring.  The February caucus idea is dead.

Even if Clinton doesn't become the nominee, I'm happy that Michigan stood up to the preferred state system and we won the primary battle.  This is the same decision that came down from federal district court in Florida last week.  Congratulations to Florida as well.

That said, I hope greee's time and money haven't been totally wasted and the federal courts give us a fix to the secret list debacle.  Thanks for the update and your work on this case greee!

What exactly does "winning" mean in this context?  At the end of the day, the DNC hasn't changed a damn thing.  Lots of changes for Michigan, though:

*a ballot with almost no Dems on it;

*forcing the state to spend upwards of $10 million for data that will be privately held by the state parties;  

*playing chicken with the seating of our delegates at the national convention.  

Looks like we got run over when we stood up to the preferred state system...

We'll see what happens in 2012.  While I agree that Obama won't be the one to force a change in the primary schedule, the DNC has a very hard choice to make this August.  If they seat Michigan and Florida, their credibility is gone.  If they don't seat Michigan and Florida, their will be a lot of resentment in both states and it will cause a lot of negetive press coverage for the nominee.
