Faux Tea Party - Rejected by Repubs on Board of Canvassers

It's only the next scene of the continuing farce, but the two Republican members voted against certifying the Tea Party petitions as having sufficient signatures.

Previous cases have held the Board of Canvassers is NOT supposed to consider the circumstances under which petitions were circulated, nor the merits of the proposal under consideration, but solely determine whether a sufficient number of voters properly signed.  (Recall Doyle OConner, Ward Connerly, and the so-called Michigan Civil Rights Initiative.)

I don't know how this will play out, but I have a general hunch Faux-Tea won't finally make the fall ballot, because eventually the Supreme Court will find a way to thwart Mark Brewer.  (Who isn't involved, of course.)

Since the Elections Division staff had (I assume) recommended approval of the Faux-Tea petitions, and since no question was raised of their proper form or the number of signatures, Mike Hodge should have no problem getting the court to order the Faux-Tea party placed on the ballot.  Whether that will really happen is anybody's guess.  If it doesn't happen, because the Court of Appeals creates some new power or duty of the Board of Canvassers to weigh the merits of petitions, we'll never see another routine qualification of a new party, or approval of most initiative petitions, since there will ALWAYS be somebody opposed, who will concoct a similar complaint.

Eventually, there will be an emergency appeal to the Supreme Court, which I expect will screw up Michigan's election law with some ill-considered newly thought up deus ex machina that favors the Republicans.  (Betty Weaver may not like them personally, but she still is one.  And she certainly doesn't want to advance  Mark Brewer's newest wacky scheme.  Even though he isn't involved.)

Update from MIRS, Monday 8/23/10: 

[At today's Board of Canvassers meeting, Mike] Hodge ... confessed that the notice of the party's July 24 convention was only sent to three people and only 10-15 people were in attendance at the Saginaw gathering."

According to MIRS, the ostensible reason for rejecting the petition was the inconsistent reference to "The Tea Party" versus the mere "Tea Party" with no capitalized definite article.  Seems like a pretty flimsy argument to this attorney, who wonders whether that standard could be applied to "the Republican Party" to disqualify its candidates, if they should happen to over-capitalize it on a filing.

Let the ridiculous posturing continue!  On to the Court of Appeals, with its uncapitalized article...

I think the only consideration is whether the signatures are legitimate and valid.  

Your sense of irony is either too high or too low for me. (0.00 / 0)
If "the only consideration" were the signatures, either they would have approved the petitions, or they'd have found something to say about the signatures.  Since neither of those happened, are you surprised?

Shinkle Is In Big Trouble (0.00 / 0)
If the courts, the AG and the State Bar are consistent and apply the same law to Shinkle, who has a law license, as they applied to a former board member who was an attorney, Doyle O'Connor, Shinkle is in big trouble.  

I hope they don't treat Shinkle the way they treated Doyle... (0.00 / 0)
... because that would require his appointment as an Administrative Law Judge.  (Doyle is doing just fine.)

Of course, Doyle also (more or less) ignored an order from the Court of Appeals.  Will they issue one here?  If they were consistent, there wouldn't be any doubt on that question.  But if Republicans had principles, they wouldn't....

Winning before the Court of Appeals is a little like having a winning record in baseball's Grapefruit League - it's only useful as conversational filler.  It certainly doesn't deserve adult attention or concern.  And it doesn't tell you anything about what will happen during the regular season.

I suppose it's possible that the wording of the relevant statute and decisions from similar cases might have some influence on the outcome.  But the central uncertainty here is whether Mark Brewer (who is not involved) gets lucky and finds four votes among the Supremes for this most recent escapade.  I'm betting not, but what do I know?

The paper situation (but not the real situation) is made slightly more complicated by the possibility that the Court of Appeals might find some pretext for declining to order Faux Tea onto the ballot, allowing the Supreme Court to screw Brewer (who is not involved) by simply not granting an emergency appeal.  To somebody who reads the case, but doesn't understand the situation, that would make it appear the case had been settled by the lower court, beneath the interest of the Supremes.  

Unless Brewer gets lucky - and of course he doesn't care one way or the other - and the Faux Tea Party is placed on the ballot, it seems almost inevitable that some sort of lasting damage is going to be done to Michigan's election law.

Does Weaver's retirement effect this?

I realize that she is the closest to a non-partisan currently available, but replacing her with a relatively non-partisan Democrat may make it even easier to follow the "canvassers can't care about fraud" precedent.

For a long time, in political cases, there has been a sense that the Court of Appeals could act irresponsibly, because they knew the Supreme Court would play games anyway.  I think there are two emerging news events that may affect the course of Faux Tea litigation.

First, the prospect of a pretty decent majority, which actually has some sense of principle and shame, is likely to shift the focus away from what-is-Brewer-up-to-and-what-should-we-do-about-it.  (Of course, I  should acknowledge we all know that Brewer isn't involved.)

But at the same time, the theoretically unrelated mess in Oakland County, concerning notarization of petitions, is creating a toxic atmosphere, where the people behind FauxTea may decide to simply fold their hands and give up the game.  If a grand jury is actually impanneled - which seems like a weird overreaction to me - a whole lot of unanswered questions might suddenly be asked in a whole new way.  I don't know that there would be any better answers, but the questions may be  enough by themselves.

Faux Tea is beginning to make any comparison to clowns insulting - to clowns.
