CMU lies to judge to bust faculty strike

George Ross, CMU president, is once again a liar*.

A copy of a court document posted on Facebook shows the administration of Michigan's fourth-largest university used false information to halt a strike by the faculty union.

Here's a link to the document in question. You'll note the stuff that's been underlined, including an assertion that the university canceled all of its classes Monday because of the faculty strike,

That's patently untrue. Classes taught by temporary (now called fixed-term faculty) faculty and graduate students were still held, and since those comprise something a little north of half the university's classes, more than half of the classes were held Monday. Hell, I've talked to people who had to attend all of their classes on Monday.

The university knew this when they got their temporary injunction Tuesday morning, since it was -- you know -- chronologically after Monday. They told circuit court judge Mark Duthie anyway, which means that they knowingly used false information to obtain a result in court.

I also today heard some rumblings that the Academic Senate -- the people George Ross, CMU president and now two-time liar, told in February wouldn't be affected by a state law he is now using to extract concessions -- may start talking about holding a "no confidence" vote for Ross. Why? It probably has something to do with the fact that the faculty refer to him as "King George."

Update! ... CMU not only didn't cancel all of its classes, it didn't cancel any classes. Sunday night, the administration sent out an e-mail to the university community with this as its subject line: "CMU seeks court injunction/students should report for classes; Staff should report for work." Quoth the e-mail:

CMU students should report for classes Monday and staff should report for work. CMU’s 439 fixed-term faculty and 591 graduate assistants will still hold classes as scheduled. 

Want more? Of course you do. We go to a statement by the adjunct/temporary/fixed-term faculty.

The Union of Teaching Faculty Strongly supports the Faculty Association in any job action needed to come to a fair agreement with the CMU administration. President Ross and the administration declare that faculty and students come first, but regrettably, as the first day of the semester arrives, there seems to be no truth to this rhetoric.

In consultation with President Laura Frey and FA/UTF liaison William Dailey, the following recommendations for UTF members have been developed regarding the current FA work action:

UTF unit members are strongly urged to abide by their contract as well as Michigan law and not strike in sympathy.

UTF unit members are strongly urged to refuse any additional work offered as a result of an FA work action.

UTF members are strongly urged to demonstrate support for the FA in any way that is not in violation of their contract, e.g. participating in peaceful demonstrations and pickets, writing letters and emails to the administration, and voicing their concern that the intractable position of the administrationundermines the honorable traditions and purpose of Central Michigan University in providing intellectual and moral education.

In other words, the unionized temporary faculty support the unionized tenure and tenure-track faculty in their strike, but are obligated by the terms of the contract they signed to show up for classes as scheduled.

Finally, from the university, after the temporary injunction was granted to the university.

All faculty and students should continue to report for classes today.

If the university canceled classes, as it told a judge, why would it tell students to continue reporting to classes.

The university's administartion not only lied to a judge, but they left a very public paper trail that contradicts it. Every local media outlet is also now aware of this, and at least one of them is working the story. 

*--Once again, an incindiary thing to say. Once again, sadly, it is just simply a truth rendered and stripped of emotional connection. The president of one of Michigan's public universities has now lied twice to achieve his aims.
