The Day the Internet turned back on

Lil' Fella, the Man Who Never Surged, and Candice Miller ... those are the three Michigan Congresscritters who have currently listed themselves as opposing SOPA/PIPA, the two bills that would squeeze the Internet on behalf of an outdated, dinosaur-like entertainment industry. And, of course, there's John Conyers, the lone Michigan Congresscritter listed as supporting it. At least, that's according to the latest whip count.

Guess where this leaves us, sunshines? In the very curious position where we're better represented in Congress by Republicans than Democrats. Oh, someone mentioned on Facebook yesterday that John Dingell's office said The Dean is uncomfortable with the bills, as written. The solution to that is very simple. Declare your opposition to the bills as written. Word on the street is that the worst elements of the bills are being written out of the legislation, so it's a very easy position to take.

Meanwhile, you can register your dissatisfaction with Michigan's only active Congressional supporter, John Conyers, by tossing some coin at state Sen. Glenn Anderson, who has spoken out against both and has in the past put his oars in the water deeply enough to have some credibility on the issue. This isn't to preclude his other primary opponent, state Sen. Bert Johnson, but as of yesterday he didn't have an active Act Blue page to donate through.

Update! ... Dale Kildee opposes. So does Sandy Levin.

That's Funny, 'cos I have a letter from Thaddeus detailing his support for SOPA (0.00 / 0)

It was typical McCotterese -- two pages of polysyllabic word salad, ultimately trying to tell me how important SOPA was and how misplaced my concerns regarding censorship and freedom of expression were, and ending with his classic sign-off "I Work for You."

Dear Mr. Helzer:

Thank you for informing me of your opposition to H.R. 3261, the Stop Online Piracy Act.  Your thoughts on this important matter are most welcome and appreciated.

As you know, Representative Lamar Smith (TX) introduced H.R. 3261 on October 26, 2011.  If enacted, this legislation would authorize the Attorney General (AG) to seek a court order against any U.S. directed foreign Internet site that is committing or facilitating online piracy to require the owner, operator, or domain name registrant of that site to cease and desist further activities constituting intellectual property offenses under the federal criminal code, including the following: (1) criminal copyright infringement; (2) unauthorized fixation and trafficking of sound recording or videos of live musical performances; (3) the recording of exhibited motion pictures; or (4) trafficking in counterfeit labels, goods, or services.

Specifically, H.R. 3261 would provide an intellectual property (IP) rights holder with a two-step process through which he or she might seek limited injunctive relief against an infringing domestic or foreign Internet site owner, operator, or domain name registrant, and would provide immunity from liability for service providers, payment network providers, Internet search engines, and domain name registries that take action required by this act, or otherwise voluntarily block access to the infringing site.  Significantly, this legislation would maintain the AG's existing authority to seek injunctive relief against and block domestic websites engaged in online counterfeiting and piracy.   H.R. 3261 would also increase criminal penalties for individuals who traffic in counterfeit medicines or counterfeit military goods.

Finally, H.R. 3261 would require the Secretary of State and Secretary of Commerce to appoint at least one IP attaché to be assigned to each U.S. embassy or diplomatic mission in each geographic region covered by a Department of State regional bureau. Presently, this legislation awaits action in the House Committee on the Judiciary.

As a staunch supporter of preserving an open Internet, I agree with you. (emphasis his)

In a related bill in the Senate,  Senator Patrick Leahy (VT) introduced S. 968 on May 12, 2011.  This legislation would authorize the AG and rights holders to bring actions against online infringers operating an Internet site or domain where the site is dedicated to infringing activities, but with remedies limited to eliminating the financial viability of the site, not blocking access.   Presently, this legislation awaits action in the Senate Committee on the Judiciary.

Most importantly, while this overly-broad legislation is an attempt to protect the theft of intellectual property on the Internet, it is imperative we do so without infringing upon an individual's access to the Internet, and also by easing concerns over online censorship.  Thus, I remain resolute in my opposition to H.R. 3261 in the House and S. 968 in the Senate.
