Michigan's finest legal mind ignored requests for help from the governor

Michigan's finest legal mind is fighting tooth and nail against same sex marriage because he believes he needs to represent the attitudes of Michigan's citizens a decade ago. That's why he's shoveling money into stopping the tide of change. Also, it's entirely rational to define marriage as between a man and a woman because won't someone think of the children? Anyway, the fact that four county clerks married same sex couples on Saturday and then the Court of Appeals stayed last Friday's ruling striking down Michigan's same sex prohibition left our benevolent overlord in something of a conundrum ... how to avoid taking a position on whether to legally recognize those marriages. He sought help from the state's attorney general.

Snyder said he met with legal counsel and contacted Attorney General Bill Schuette’s office to understand the complexities of the issue. Schuette’s office did not respond, Snyder said.

“We did our own research,” the governor said. “We believe this is the appropriate position to take.”

Snyder declined to speculate on why the attorney general did not respond to his request. Schuette’s office was not immediately available for comment.

Probably it's a good thing that our benevolent overlord didn't get any advice from Michigan's finest legal mind, as based on past performance it would have been costly, wrong advice.

Meanwhile, a white nationalist group has gathered under the banner of Michigan's finest legal mind.

Oh yeah, Jack Lessenberry writes about this. As is the case with about 80 percent of what Jack Lessenberry writes, it's pretty good (that's a better track record than my own two-thirds, by the way).

What's so complex about that?

The Traditionalist Youth Network's amicus brief would easily win for "Worst Advocate" and "Worst Advocacy." I wouldn't be surprised to learn that the brief was written on the back of place mats from the local Chick-Fil-A. In Crayola.

I understand there's one on the Oakland U campus. Soon to be one at DTW, per the Wayne County Airport Authority website. Not that I'll be patronizing it, there's also going to be a Zingerman's. Maybe it was the Cracker Barrel in Belleville or Roseville.

Now, there indeed was a reasonable and intellectually sound argument that could be made against legalizing same-sex marriage. And that is the fact that in 2004, Michigan voters overwhelmingly amended the state constitution to forbid any marriage that wasn't between a man and a woman.

Schuette, a 60-year-old former congressman from Midland, could indeed have found respectable constitutional scholars to argue that case, and could have done so with dignity, not to mention less expensively for the taxpayers.

This is a less antagonistic argument, sure, but I'd hardly call it "reasonable and intellectually honest."  People need to stop giving others cover when they haven't owned it or deserve it.  I can see giving that position the label of being less repugnant, but let's not go to far with this "reasonable and intellectually honest" BS, because that argument is neither.


Schuette Job (2.00 / 1)
Don't condemn Schuette for defending the marriage amendment.  Don't go down the road of insisting the attorney general should pick and choose what laws to defend or enforce.  I guess its inevitable that both sides will play politics with this but sometime someone somewhere should take the long view.

But let's all agree Schuette is a terrible attorney general and richly deserves to be defeated for re-election.  If Totten's the guy, lets marshal enough resources to allow him to make a serious run.  The MDP and the national interest groups have a less than stellar record of supporting our AG candidates recently.
