Glenn Steil, Jr. - Off his rocker again!

It seems like I am just picking on Glenn Steil Jr. I promise; I am not singling him out? he is just so bad that he requires a bit more attention than some others at the moment. Mr. Steil has also been a little more active in pushing his agenda than the others so far in this new Congress.

Yesterday, Steil introduced HR 10 - 2007, a resolution to "memorialize the United States Congress to adopt and present to the states for ratification an amendment to the United States Constitution to prohibit the counting of illegal immigrants in the tabulations of population for purposes of apportioning members of Congress among the states".

I am not going to even get in to the issue of solving the Immigration issue here; it is irrelevant to my argument. I will however, argue the sanctity of our U.S. Constitution. Why would any American ever wish to make our Constitution a restrictive document. While I agree that the US Constitution is a living document; it is the grantor of our rights as citizens and should never be used to remove or restrict the rights of the people. There has only been one restrictive amendment, the 18th, which was repealed by the 21st.

Some will argue that since the resolution is dealing with illegal immigrants, and not US citizens, and that it does not apply as a restriction. This is true. However, my question is this: Why amend the US Constitution when this issue can be handled through proper legislation?

Glenn Steil Jr. is actually promoting an agenda which seeks to harm his constituency. By removing the counting of immigrants from the census, fewer federal funds will flow in to his district. There are several issue that many Americans have with illegal immigrants. (As I mentioned earlier, I do not wish to debate the immigration issue here, so I will stick to the argument that deals with this particular resolution.) Illegal Immigrants utilize public services such as hospitals, schools, etc. Many Americans believe that this is an unfair drain of the public resources. Mr. Steil asks that the illegal immigrants not be counted in the census. However, it is the census which determines federal funding for each state and districts within the state to provide for the basic services being utilized.

This resolution has been referred to the Committee on Oversight and Investigations, and I do not expect that it will even make it out of committee; let alone making it to the floor for a vote. But it interesting to sit back and watch how Glenn Steil, Jr. is spending his time. He is not servicing his constituents. He is wasting his time. He is denying his district of proper representation and ignoring the many problems which Michigan is facing.

She did so in the last Congress. One of her arguments is that not counting illegal immigrants would increase Michigan's House delegation by at least one seat.

Quite aside from the political calculus, I liked the idea from Miller.  The language she was wanting to change was in the 14th Amendment, from:

Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed.

to:

Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of citizens in each State, excluding Indians not taxed.

made sense to me.  The "whole number of persons" language was symbolic, dating back to the historical constraints on citizenship and "3/5th of a person" compromise for slaves.  (Contrary to the initial diarist, this was another bit of "restrictive" Constitutional language contested in minor scuffles like the Civil War.  Tell me, why can't people under age 18 vote?)  Once we expanded the range of citizenship, the idea was that if you were a citizen (which now included most everyone) and were subject to taxes (true except for the semi-autonomous Indian tribal nations), you mattered for representatives.  Taxation without represenatation was a key component.

Enter illegal immigrants -- in droves.  They pay taxes if applied to them (or their aliases/stolen SS#s), largely to mask the fact that they're around illegally.  Should paying taxes to hide from the law entitle them to representation (above and beyond "equal protection", assuming you accept that there's a line between protection and representation)?  What should happens to illegal immigrant taxpayers paying under their own SS# who become legal -- that was a question Bouchard tried to hammer Stabenow on but no one got it (including Bouchard :) )?  Should political gain be derived by being a magnet for illegal immigrants?  If I'm Texas or California, there's not much incentive for me to enforce my border, is there?  There's a whole lot that doesn't neatly fit along party lines, and we're reduced to fighting along petty lines while the problems get unfixed.
