January 15 Primary Challenge-Request for Volunteers

by: greee

Wed Nov 14, 2007 at 22:27:26 PM EST

I will be filing what is known as an implementation challenge to the Democratic Party's decision to go with a 1/15 primary.

This primary violates the DNC rules.  Much worse than that, it violates the delegate selection plan that was adopted by the Michigan Democratic party. Our Governor, Jennifer Granholm, is pushing this primary as a means to advance the candidacy of Hillary Clinton, whom she has endorsed.

As a result of her efforts, those of us who wanted to vote for one of the four candidate who withdrew from the primary now do not have a voice.  (Save your breath, Hillary supporters-all of the candidates signed a pledge not to participate in any primary or caucus not sanctioned by the DNC.  For Hillary, it depends on what the definition of "participate" is.  For the rest of the reality based community, Hillary has violated her pledge).

greee :: January 15 Primary Challenge-Request for Volunteers
The challenge rules requires the support of 15 members of the state party.  I am asking supporters of Obama, Biden, Richardson and Edwards to join this challenge.  If you want to participate, please email me at giveusavoice2008@gmail.com.

We were appalled when Katherine Harris deprived Florida Democrats of their vote in 2000.

We were appalled when Ken Blackwell deprived Ohio Democrats of their right to vote in 2004.

We should be appalled when our Governor works to deprive us of our vote in 2008. More importantly, we should fight back.

Count Me In (4.00 / 1)
I hope it doesn't come to this, but we need to be prepared to file this challenge by Friday.

Consider me part of the Michigan 15.  I'm Party ID: 43421.

It's not a real "primary" if it doesn't elect delegates.

But, Chairman Brewer and the rest of the ExecCom, please step back and don't let it come to this.

I urge all Party members to email gree -- supporters of all candidates from all areas of Michigan.

AP Report on Appeals Hearing (4.00 / 2)
WTOL, Toledo (state down south): http://www.wtol.com/...

Associated Press - November 15, 2007 3:34 PM ET

LANSING, Mich. (AP) - State officials hoping to save the January 15th presidential primary faced a skeptical appeals court panel today.

The three-judge panel peppered both sides with questions about the case.

They ended the hearing without saying when they might issue a ruling. But they say the understand the importance of a speedy decision.

State officials want the matter decided because elections clerks need to begin mailing out absentee ballots to Michigan voters overseas with the military or for other reasons by December First if the primary is to be held on January 15th.

At issue is whether the appeals court should let stand a lower court's ruling that the primary election law is unconstitutional.

Detroit News on Appeals Hearing (4.00 / 1)
Gordon Trowbridge, Appeals court judges may not rule by Friday on voter lists: http://www.detnews.c...

LANSING -- A three-judge appeals court panel on Thursday questioned how the state can legally hand over voter lists from the Jan. 15 presidential primary to the Democratic and Republican parties, casting renewed doubts on whether the contest will be held.

The judges were hearing the state's appeal of a ruling last week that the law establishing the primary is unconstitutional because it calls for delivering the lists from the state-funded election to the parties but bars the information from the public. That view seemed to earn some sympathy from the appeals court judges, who also hinted that they may not rule in the case by Friday, as the state requested....

All 17 Democratic Senators voted NAY or did not vote.  Not a single Democratic Senator voted YEA on Immediate Effect.

So, if Dingell pushes the 15 January Bill through it will be against the wishes of the entire Democratic Senate Caucus (and with the aid of Bishop-Cox-Land).
