What's a little election fraud between friends

Everyone saw this yesterday, which makes me the last to mention it. Again, I have little to add that others probably haven't already noted, but it has to be acknowledged ... Jase Bolger once again disgraces the state Legislature. That would make twice in less than three months.  I realize we're all supposed to be proud and shit that they managed to pass a budget before Oct. 1 (no one appears to care whether it's a good budget focused properly and addressing the real needs of the state, but that's another story), but the House Speaker is an embarrassment to the state. Or, let the report from the Kent County prosecutor speak on its own.

 ... Incredibly, while it would be illegal to pay a boxer to take a "dive" or a basketball player to "point-shave," it is not currently a crime in Michigan to recruit someone to run for public office, place them on the ballot at the "eleventh hour" and essentially pay them to make no effort to win.

As a Republican elected official, I am embarrassed and offended by what transpired.

If you haven't read the report, perhaps the most damning thing is that the prosecutor says that the least culpable figure involved is the only person who might have violated the law. The prosecutor also suggests that the Legislature ought to make this a crime, which given the facts of the report he issued is literally asking the fox to nail a giant board over the fox-sized hole in the chicken coop.

Amazing what they were able to put together on their own.
Every time I read about it, I expect to find that somebody has traced it back to the Oakland Dems.  Even if there's no explicit connection, I'm sure they served as an inspiration.

You are not the last to report this. The Oakland Press, as of this A.M., has not mentioned it. And when they do, they too will have people comparing it to the Oakland Dems. As if the Speaker's lack of ethics is comparable.

Didn't mean to compare their lack of ethics.
The real rivalry is, who is most incompetent?

Roughly a tie, based on the facts that have emerged to date.

I'm sorry, but I don't buy for a minute that Forsyth can't prosecute either Schmidt or Bolger for some kind of elections shegnanigans, here.  I think he's trying to have it both ways in that he gets to come across as some honest broker and criticize his own party, but not so independent that he leads to taking down one of them and potentially angering some folks.  That Jase is going to get away with something so incredibly disgusting leaves me in disbelief.

Proof beyond a reasonable doubt
Prosecutors don't like to lose, and the law stacks the decks against them, at least when the defense has money to hire their own attorneys.

Even if the case looks solid at the start, it's likely to develop a few leaks as the defense cross-examines your witnesses, and the judge is forced to rule repeatedly on various motions.  Somewhere, some investigator on your side has written down something that will make your case look fishy if it's examined by a crafty lawyer.  You can still get a conviction most of the time, but what starts as a slam-dunk often becomes a pitched battle along the way.

But if your case looks iffy at the start, it'll certainly turn into mush long before you get to a jury.  If YOU can see a gap in the logic, or a reasonable alternative way to read the statute under which you've brought the charge, the whole thing is likely to blow up in your face.

If you limit yourself to what appear to be slam-dunks, you can win 80%+ of the cases that actually go to trial against retained counsel.  I haven't chased down all the law in this case, but from my knowledge of election law, I'd be very squeamish about taking it to trial.

Of course, if the defendants were forced to rely on appointed counsel, you'd have a better chance to get a conviction.  But that's because, against appointed counsel, you'd have a fair chance of convicting a person selected at random of a charge drawn out of a hat.
